PENSION SECURITY OF PERSONS DISMISSED FROM MILITARY SERVICE AND CERTAIN OTHER PERSONS: CURRENT STATUS, PROBLEMS AND PROSPECTS

The article examines the current state of pension provision for persons discharged from military service as one of the key elements of social protection under martial law. The regulatory and legal principles governing the assignment of pensions to persons discharged from military service and some other persons are disclosed. The features of the accrual and payment of the main types of pensions are studied - for years of service, for disability as a result of war and in case of loss of breadwinner. The conditions of assignment, the procedure for calculation and the features of the accrual of additional allowances and increases to pensions for persons discharged from military service are determined. It is emphasized that combat payments do not affect the amount of pensions, since they are temporary in nature and are assigned only for the period of martial law. Special attention is paid to the issues of preferential calculation of years of service for military personnel who participated in measures to ensure the defense of the state, as well as to social guarantees for participants in hostilities and persons with disabilities as a result of war. It is determined that the current pension system is multi-level and performs not only a social but also a motivational function, contributing to the involvement of citizens in service in the Armed Forces of Ukraine. The article substantiates the need to improve the mechanisms for calculating pensions, introduce automated recalculation of payments, ensure fair consideration of preferential service, and increase pensions taking into account inflation. It is concluded that the reform of the pension system for military personnel should be aimed at ensuring its stability, transparency, and social justice, which will increase citizens' trust in state institutions and contribute to strengthening social security in Ukraine.
